FodPlan App Terms of Service
Effective from 27 October 2026.
1. General provisions
1.1. These Terms set out the rules for using the FodPlan mobile app (the “App”), provided by ADAMIT Adam Hałuszczyński, ul. Kolejowa 35, 05-860 Płochocin-Osiedle, Poland, Tax ID (NIP) 5291697421, email: contact@adamit3d.com (the “Provider”).
1.2. The App is a meal planner for people following a low FODMAP diet: it contains meal plans, recipes, shopping lists, a food search, a wellbeing diary, educational materials and reminders.
1.3. The basic features of the App are free of charge. Additional features are available in the paid Premium subscription, on the terms described in section 8 and in the Subscription Terms. Using the App does not require you to create an account in the App. Purchasing Premium requires an account with an app store (Apple or Google).
1.4. By installing or launching the App, you accept these Terms. These Terms also constitute the licence terms for using the App (Terms of Use / EULA) within the meaning of the app stores' rules.
1.5. The App is intended for people aged 18 or over.
2. Technical requirements
To use the App you need a phone running iOS or Android in a version supported by the App (stated in the store from which you download it). The App works without an internet connection. A connection is needed to download and update the App, to purchase and verify a subscription, to look up a product by barcode in the Open Food Facts database, and to open external links.
3. Informational nature – this is not medical advice
3.1. The App is informational and educational in nature. It is not a medical device, does not diagnose, treat, alleviate or prevent any disease, and does not replace the advice of a doctor or dietitian.
3.2. The low FODMAP diet is recommended to be followed after a medical diagnosis and under the supervision of a clinical dietitian. The elimination phase should be short (usually a few weeks).
3.3. Before starting the diet, consult a doctor, especially if you have any of the warning symptoms described in the App in the “Health information” section (including blood in the stool, unintended weight loss, fever, night-time diarrhoea, anaemia), if you are pregnant or breastfeeding, have an eating disorder or have a chronic illness.
3.4. Calorie and nutritional values, portion limits, and the results of the search, the calorie needs calculator, the label and barcode scanner and the diary analysis are approximate. Food tolerance is individual. Conclusions from the diary are observations of correlation, not a diagnosis of the cause of your symptoms. The label and barcode scanner is not a test for allergies or intolerances, and its reading may be wrong; always read the product label and check for allergens.
3.4a. The barcode scanner uses data from the Open Food Facts database, which is created by a community of users and made available under the Open Database License (ODbL). The Provider does not create or verify this data; it may be incomplete or wrong, and a product may not be in the database. How the code number is sent is described in the Privacy Policy.
3.5. Where a recipe or product is marked as gluten-free or lactose-free, this applies to preparation using products that carry such a marking on their packaging.
4. Rules of use and copyright
4.1. The Provider grants you a non-exclusive, non-transferable licence to use the App on your devices, for personal purposes, in accordance with the Terms.
4.2. The App and its content (including recipes, texts, graphics, layout and the selection of data) are protected by law. Without the Provider's consent you may not copy them in whole or in any substantial part, systematically extract them (e.g. automatically), distribute them or use them commercially, subject to any rights arising from applicable law.
4.3. You may not use the App in a way that is unlawful, circumvent the subscription safeguards or disrupt the operation of the App.
4.4. Names and trademarks of other parties mentioned in the App are used for description only and belong to their owners. This does not imply any cooperation with, or endorsement by, those parties.
5. Personal data
The rules for processing data are described in the FodPlan Privacy Policy. Data you enter in the App (plan, settings, diary) stays on your device.
6. Liability
6.1. The Provider makes every effort to ensure that the App works correctly and that its content is reliable, but does not guarantee that it will work without interruptions or errors, or that the content will be suitable for your state of health.
6.2. You make decisions about your health and nutrition yourself, ideally after consulting a specialist.
6.3. Nothing in the Terms excludes or limits the Provider's liability to the extent that it cannot be excluded or limited under applicable law, in particular liability for personal injury and for damage caused intentionally, or consumer rights arising from the rules on the conformity of digital content and digital services with the contract.
7. Complaints
You can report errors in the App's operation or objections as to its conformity with the contract to the email address given in section 1.1, describing the problem, your phone model and your system version. We will reply within 14 days of receiving your report. In matters of payments and refunds you can also contact the store where the purchase was made.
8. Premium subscription
8.1. Premium is a paid digital service, provided in billing periods (one month, 3 months, one year), with automatic renewal. You will see the scope of Premium, the price and the trial period on the purchase screen before you enter into the contract.
8.2. Payment, cancellation and refunds are handled by the store where you buy, on the terms described in the Subscription Terms. Those terms form part of these Terms.
8.3. The features available free of charge and the Premium features are described in the App. The Provider may change the scope of features (including moving features between the free version and Premium) for a valid reason, e.g. a change in law, development of the App or maintenance costs, at no additional cost to you, with at least 14 days' notice and a notice in the App. If a change materially worsens your access to the digital content you use, you may end the contract (cancel the subscription) free of charge within 30 days of the notice of the change or of its introduction, whichever is later.
9. Ending your use
You can stop using the App at any time by removing it from your phone. Removing the App, or deleting data in More → Delete my data, does not cancel your subscription; cancel it in your store's settings.
10. Changes to the Terms
We will notify you of changes to the Terms in the App and on the website at least 14 days before they take effect. If a change is not acceptable to you, you can stop using the App and cancel your subscription.
11. Governing law and disputes
11.1. These Terms are governed by Polish law. If you are a consumer living in another country, this does not deprive you of the protection afforded by the mandatory provisions of the law of your country.
11.2. A consumer may use out-of-court dispute resolution, including by contacting a municipal or county consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or the Voivodeship Trade Inspectorate (Wojewódzki Inspektorat Inspekcji Handlowej). Information about these options is available on the website of the Office of Competition and Consumer Protection (UOKiK) (uokik.gov.pl).
